Gorman Roberts appeals his conviction for manslaughter in the tragic drowning death of five- year old Jordan Payne in a local canal. He contends that his post-arrest videotaped statement should have been suppressed, because the Miranda *fn1 warning he received failed to inform him that he had a right to have an attorney present during questioning. As a result, he argues, he did not knowingly and intelligently waive his constitutional rights under Miranda. We agree and reverse.
